Terms of Service

1. Agreement to Terms

By registering for or using the HR Collective platform ("Platform"), operated by HR Collective Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering a binding contract under Nigerian law. By using the Platform, you represent that you meet these requirements.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and current information during registration.
• You may not share your account or allow others to access the Platform using your credentials.
• You must notify us immediately at support@hrcollective.io if you suspect unauthorised use of your account.

4. Professional Vetting

HR professionals must complete our 6-stage vetting process before being listed on the marketplace. By submitting your profile for vetting, you consent to:

• AI-based assessment of your interview and technical responses.
• Third-party identity and credential verification.
• Publication of your AI Intelligence Report on your marketplace listing.

We reserve the right to reject or suspend any professional who provides false information or fails to meet our quality standards.

5. Contracts and Engagements

• All engagements between clients and professionals are governed by a platform-generated contract signed by both parties.
• Contracts become binding upon the digital signatures of both the client and the professional.
• The Company acts as a facilitator only and is not a party to contracts between clients and professionals.
• Both parties are responsible for fulfilling their contractual obligations.

6. Payments and Escrow

• Payments are processed via Flutterwave and held in escrow until milestone approval.
• The Platform charges a commission on each completed payment. The applicable rate is displayed at the time of contract formation.
• Escrow funds are released to the professional upon client sign-off of each milestone.
• Professionals withdraw earnings to their registered bank account. Withdrawal processing times depend on the banking provider.
• All prices are inclusive of applicable taxes unless stated otherwise.

7. Dispute Resolution

In the event of a dispute between a client and professional:

• Either party may raise a dispute through the Platform within 7 days of the triggering event.
• Both parties must submit evidence within 5 business days.
• A Platform administrator will review evidence and issue a binding resolution within 7 business days.
• The administrator's decision is final and binding on both parties.

8. Prohibited Conduct

You agree not to:

• Provide false or misleading information in your profile or during vetting.
• Circumvent the Platform to conduct engagements outside it with clients or professionals you met through it.
• Engage in any form of harassment, discrimination, or abuse of other users.
• Attempt to reverse-engineer, scrape, or disrupt the Platform.
• Use the Platform for any unlawful purpose.

Violation of these prohibitions may result in immediate account suspension and legal action.

9. Intellectual Property

All Platform content, branding, and technology are the property of HR Collective Ltd. Users retain ownership of content they upload (CVs, work samples) but grant the Company a licence to use such content to provide Platform services.

10. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform, including loss of earnings, data, or opportunity. Our total liability to any user shall not exceed the fees paid to us in the 3 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for breach of these Terms or for conduct that is harmful to the Platform or other users. You may close your account at any time via Settings. Outstanding contractual obligations survive termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lagos State.

13. Changes to Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
